The guide to using PAIA

The Information Regulator publishes a plain language guide on how to use the Act, under section 10, in every official language. It is free, and you can get it from inforegulator.org.za or by asking the Regulator for a copy.

Records we keep

This is a one person business, so the list is short. None of these records are automatically available without a request.

Bookings and guests

  • Enquiries and messages from guests, through the contact form, on WhatsApp, by email or by phone
  • Booking details: dates, group size, dietary needs and other requests

Partners and suppliers

  • Referral arrangements with hostels, hotels, guesthouses and Airbnb hosts
  • Contact details for local cooks, vendors, artists and venues on the route
  • Listings and correspondence with booking platforms

Money and tax

  • Invoices, receipts and records of payments received
  • Bank statements and tax records

The business itself

  • Registration documents, licences and the tourist guide registration
  • Insurance documents, if any are in place
  • Photos, videos and marketing material, including what is published on this website

Records kept because other laws ask for them

  • Income Tax Act 58 of 1962 and Tax Administration Act 28 of 2011
  • Value Added Tax Act 89 of 1991, if the business is registered for VAT
  • Companies Act 71 of 2008, if the business is a registered company
  • Basic Conditions of Employment Act 75 of 1997, if anyone is employed
  • Protection of Personal Information Act 4 of 2013
  • Tourism Act 3 of 2014

How to request a record

  1. Fill in the prescribed request form for a private body, downloadable from inforegulator.org.za.
  2. Say which record you want, in enough detail for it to be found, and how you would like to receive it.
  3. Say which right you are trying to exercise or protect, and why the record is needed for it. The Act asks for this.
  4. Send the form to ogblackacex@gmail.com, or hand it in at the address above.

You get a decision within 30 days. That period can be extended once, by another 30 days, and you will be told if it is. If access is refused you will be told the reason and what you can do next, which is an application to court.

A request fee and access fees apply, as set out in the PAIA Regulations. The current amounts are published by the Information Regulator, and you will be told what your request costs before the work is done.

When a request can be refused

Chapter 4 of the Act lists the grounds. The ones that come up here are somebody else's privacy, information given to us in confidence by a partner or supplier, commercial information belonging to another business, and legal privilege.

Personal information

Whose personal information we hold, why, who else sees it and how long it is kept is set out in full on the privacy page. In short: guests who make a booking, partners and suppliers we work with, and nobody else. It is used to run the bookings and the business, and it is never sold.

Availability of this manual

This manual is available on this page, at the business address on request, and from the Information Regulator. Business details and booking terms are on the legal page.
